In 2018 Congress passed the Farm Bill, legalizing the sale of hemp products with 0.3% or less of Delta 9 THC. This allows for the sale of Delta 8 THC products, if it is derived from hemp. Though Delta 8 THC is federally legal, some states have banned Delta 8 THC.
